Quality Customer Service is our number one aim at the Watersports Hub. We work in partnership with our community and try our hardest to be as fair as possible in every situation. We invite our customers to read our general terms & conditions below.


SUMMARY

These terms and conditions apply between you, the User of the Watersports Hub Services. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of our services.

In these terms and conditions, User or Users means any third party that accesses our services and is not either (i) employed by companies under the umbrella of The Watersports Hub and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to The Watersports hub and accessing the service in connection with the provision.

You must be at least 18 years of age to use our services, and by using the service and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

SCOPE OF SERVICES

We are open for Stand Up Paddleboard, Open Water Swimming, Water Safety & Kite Surfing lessons. We have adapted our services inline with the government social distancing guidelines to ensure that our services are safe for both staff and customers. We require your full cooperation during this time.

PAYMENTS

We are a cashless business and will not accept payments in cash. We accept all forms of card payments including American Express. We will take card details on booking and full payment will be withdrawn on the completion of your session.

LOCATION/ ARRIVALS

Our services are delivered off the beach in Eastney, Southsea or other locations specified in your booking.

Please do not attend your booking if you are displaying Covid-19 symptoms or have come into contact with someone displaying symptoms or diagnosed with the virus.

Adhere to the Government’s social distancing guidelines at all times.

On arrival, please wait at the allocated greet point and your instructor will be available to support you with your equipment hire booking.

We do not offer any changing facilities or toilets, so please arrive 5 minutes before your booking start time and be ready for your booking.

Our services allow time in-between lessons to allow for disinfecting and social distancing measures.

Please do not touch any equipment that has not been allocated for your booking.

DEPARTURES

Once you have finished your session we ask you to leave your equipment with your instructor for disinfecting.

Please leave the area as quickly as possible to avoid overcrowding.

CANCELLATIONS & REFUNDS

The Watersports Hub maintain the right to cancel bookings at any time should they deem the weather conditions unsuitable for your booking. We are not responsible for the weather, therefore refunds are not given due to weather conditions. In this instance, customers will be offered digital vouchers to the full value of the booking which can be redeemed any time in the future. If you do not arrive for your session, we will take payment on completion of your booking duration.

EQUIPMENT

We take great care when it comes to your safety, therefore our equipment is regularly checked for damage and aesthetic degradation. Any obvious lack of care, misuse or mindless behaviour that results in our equipment being damaged, will result in a fair charge being issued. If you discover any of our equipment is faulty, please report it to a member of staff prior to the start of your activity otherwise you may fall liable for charges associated to the damage. It is the responsibility of the person using the equipment to report any damage caused during the activity. By participating in an activity, you thereby agree to take responsibility for and pay for any damage caused by improper use. When making your booking it is implied and accepted that you have read and understood the booking conditions. If you are liable for damages to the equipment we will charge on completion of your booking duration.

Charges include:

£100 for a punctured paddle board

£80 for a lost paddle

£500 for a paddleboard that is not fit for purpose and future hire

HEALTH & SAFETY

The Watersports Hub companies are covered by high quality customer liability & employee liability insurance.

All customers must complete and sign our activity safety information form to acknowledge and accept the risks involved with taking part in our services.

All customers must be able to swim 50 meters and be confident in open water.

All customers must be physically fit. Anyone with a medical condition must seek medical advice before participating in our lessons.

If you are perceived to be under the influence of alcohol or illegal drugs,  you will not be permitted to undertake any activities.

All customers must undertake our safety brief on every occasion that they attend activities with us. This is to ensure everyone is made aware of the skills they will need to cope with the weather and environmental conditions of the day. All customers are also required to wear a buoyancy aid (supplied by The Watersports Hub) and this must be worn correctly throughout the duration of the paddlers time on the water. 

The Watersports Hub reserves the right to refuse participation to anyone considered to be unwell, under the influence of alcohol or drugs or if deemed to cause harm to him/ herself or any other individual within proximity.

CUSTOMERS WITH DISABILITIES

If you have a disability or medical condition please contact us to discuss your needs and we will do our best to help by working with our instructors to assess your individual needs relative to the activities. We must also be informed of any medical conditions (asthma, epilepsy, deafness etc) any participant has.


INSURANCE

All participants must be aware of and accept the risks associated with outdoor activities. We carry £5 million public liability insurance. Details are available on request. Participants are strongly advised to arrange their own personal holiday insurance to cover cancellation and personal injury. The Watersports Hub is under no liability whatsoever in respect of loss or damage to property, however caused.

When making a booking you are agreeing to our terms and conditions. These are available to view at any time on our website. You will be automatically added to our mailing list to receive occasional offers and news. You can opt out from these emails anytime using the 'unsubscribe from this list' link at the bottom of the emails.

PRIVACY POLICY AND COOKIES POLICY

LIMITATION OF LIABILITY

Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

GENERAL

  1. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

  2. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

  3. These terms and conditions together with the Privacy Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

  4. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

  5. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

  6. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

  7. These terms and conditions will be governed by and interpreted according to English law. All disputes arising under these terms and conditions will be subject to the exclusive jurisdiction of the English courts.
